Vehicle cameras and GDPR – stay on the right side of the law

When new privacy rules were introduced across the EU in May 2018 – the General Data Protection Regulations (GDPR) – there was much debate among commercial vehicle operators around the subject of on-board CCTV.

Concerns were expressed that the act of recording video footage during journeys (and when a vehicle is parked) might be a breach of GDPR. Information in the media was patchy and sometimes misleading.

We’ve worked hard over recent months to reassure our customers of the facts around GDPR and CCTV, and as the new laws have come into force, we’re pleased to report that the system is working well. Are vehicle camera systems GDPR compliant?

The simple answer is that digital recording equipment cannot in itself ‘comply’ with GDPR legislation. GDPR relates to how data is handled – not the hardware recording that data. It’s important, however, that the hardware and related software offer features and benefits that will enable the operator to keep data secure.

For example, Brigade’s MDR-50X series digital recorder has new admin isolation rights, ensuring that operators can restrict access to data. This model also has a non-visible watermark so that tampered files will not play, alongside password-protected software and a lockable hard drive.

There are various measures that operators must take to ensure full compliance with privacy legislation. These include:

• Wiping data after a specified amount of time
• Registering with the Information Commissioner’s Office (ICO) and informing them within 72 hours of any privacy breach
• Placing stickers inside a cab and externally on the vehicle to warn drivers, passengers and the public that CCTV equipment is in operation.
